Please read these Terms of Service ("Terms," "Terms of Service") carefully before using the NinetyDays mobile application (the "App") operated by NinetyDays ("us," "we," or "our").
By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.
1. Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our App.
You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Guest Accounts: You may use the App in guest mode without creating an account. Guest mode data is stored locally on your device only and is not backed up to our servers. We are not responsible for data loss if you uninstall the App or lose your device while using guest mode.
2. Subscriptions
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (such as monthly or annually), depending on the type of subscription plan you select when purchasing.
Free Tier: Limited to 3 active habits.
PRO Tier: Unlimited habits and access to premium features.
We reserve the right to modify tier limitations and features with reasonable notice.
- Payment: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
- Auto-Renewal: Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.
- Renewal Charges: Your account will be charged for renewal within 24-hours prior to the end of the current period.
- Management: You can manage and cancel your subscriptions by going to your account settings on the App Store or Google Play Store after purchase.
- Refunds: Refunds are handled by Apple or Google in accordance with their respective refund policies.
3. Intellectual Property
The App and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of NinetyDays and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries.
4. User Content
Our App allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the App, including its legality, reliability, and appropriateness.
By posting Content to the App, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the App. You retain any and all of your rights to any Content you submit, post or display on or through the App and you are responsible for protecting those rights.
5. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.
6. Limitation of Liability
In no event shall NinetyDays, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
7. Disclaimer
Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.
9. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
10. Data Portability
You have the right to request a copy of your data in a machine-readable format. You can export your habit data and check-in history from within the App settings or by contacting us at support@ninetydays.com.
